本政策适用于心诗易企业管理咨询(上海)有限公司（“我们”）通过实体店、网络平台包括微信（如适用）及流动应用程序为您提供的所有产品及/或服务，包括但不限于： KLUB 11会员服务、K11 Kulture Academy、K11 Atelier Academy、K11 Artist Klub、K11 Design Store、ChiK11 art space、停车场智能寻车服务、K11 Atelier闸机服务、K-Wallet、K11无感积分等。需要特别说明的是，本政策不适用于其他第三方向您提供的产品及/或服务，我们建议您向第三方提供您的个人信息前先阅读该第三方的相关隐私或个人信息保护政策。如果我们通过第三方平台向您提供的产品及/或服务，则根据实际情况第三方平台的相关隐私或个人信息保护政策及本政策可能同时适用。
在您使用我们提供的任何产品及/或服务前，请仔细阅读并确认您已经充分理解并同意本政策的内容。如果您不同意本政策的任何内容，或对本政策有任何疑问、意见或建议，请通过第12条的联系方式与我们联系。
• 新世界集团关联方：指新世界发展有限公司(New World Development Company Limited)、K11 Concepts Limited（统称为“新世界集团”）的关联公司，即K11 Group Limited、超领域（深圳）网络有限责任公司及其关联公司、周大福珠宝集团有限公司，及其各自的控股公司、关联公司、附属子公司、以及彼等拥有权益的任何公司。
• 个人信息：指以电子或者其他方式记录的能够单独或者与其他信息结合识别特定自然人身份或者反映特定自然人活动情况的各种信息。本政策中涉及的 个人信息包括称呼、个人姓名、身份证件或其它有效证件、电话号码、电子邮箱地址、地址、出生日期、年龄范围、会员账号名称及密码（包括K11会员号）、首选语言、职业、办公地点、收入区间、婚姻家庭状况、教育经历、个人兴趣及偏好、交易或消费记录、
银行帐号、网页浏览记录、位置信息、通信记录和内容、微信ID、系统账号及识别码包括由微信生成的Open ID、国籍、指纹及脸部特征（如适用）、车辆信息、车牌号、实体K11物业通行卡号。
• 个人敏感信息：指一旦泄露、非法提供或滥用可能危害人身和财产安全，极易导致个人名誉、身心健康受到损害或歧视性待遇等的个人信息。本政策中涉及的个人敏感信息包括：身份证件或其它有效证件、收入区间、网页浏览记录、位置信息、银行帐号、交易或消费记录、通信记录和内容、微信ID、系统账号及识别码包括由微信生成的Open ID（适用于2020年10月1日前）、指纹及脸部特征（如适用） 、
电话号码（适用于2020年10月1日前）。我们会在本政策对个人敏感信息以粗体进行显著标识。另外，我们也会在收集您的指纹及脸部特征前另行告知相关规则并获得您的同意。
a) 为注册成为会员、建立及管理您的会籍，并获得我们为会员提供的服务、资讯及优惠（如适用），您需要透过微信、短信、电邮、网络平台、应用软件及/或其他方式向我们提供以下个人信息（如适用）：您的个人姓名、出生日期、性别、电话号码、电子邮箱地址、国籍、婚姻家庭状况、住址、脸部特征、身份证、护照、职业、教育经历、会员账号名称及密码、微信ID、系统账号及识别码包括由微信生成的Open ID、个人兴趣及偏好等出行方式、交易记录。
b) 根据您提供的个人信息，我们可能不定时根据我们的会员计划的条款和细则及符合法律法规的情况下，通过微信、短信、电邮、网络平台、应用软件及/或其他方式向您发送关于我们及/或新世界集团关联方包括奖赏、服务、福利、促销、推广、礼遇、优惠或类似项目的资讯，以及处理及核实与您的会员积分及评级相关事宜。在符合法律法规的情况下，我们可能会进行数据（包括但不限于您的个人信息、您在我们及/或新世界集团关联方购买产品及服务的交易记录）整合、分析及/或研究，务求让您了解及享受由我们及/或新世界集团关联方提供的多元化及更个性化的产品及服务，提升您的整体消费体验。
c) 如果您不希望接收我们及/或新世界集团关联方产品及/或服务的资讯，您可通过本政策第12条的联系方式与我们联系。
3.2 下单、支付及交付
a) 当您下单订购我们的产品及/或服务时，您需要先注册成为我们的会员并提供收货人姓名、收货地址、收货人联系电话、收货人电子邮箱地址，以让我们生成您购买该产品及/或服务的订单。同时该订单会载明您所购买的产品及/或服务信息、订单编号、订单生成时间、交易金额（“订单信息”）。这些信息是为了顺利完成交易及配送、保障交易安全、让您查询订单信息、进行客户回访、提供客服咨询与售后服务。
b) 为完成订单交易，您可以选择以现金、透过第三方支付机构或金融机构提供的支付系统或应用软件付款。如果您选择透过第三方支付机构、金融机构支付系统或应用软件支付，您需要提供您的帐号、卡号、有效期及该机构、系统或软件可能要求提供的个人信息包括个人姓名、出生日期、性别、国籍、住址、电话号码、电子邮箱地址、指纹（如适用）、会员帐号名称及密码、邮箱地址、微信ID、系统账号及识别码包括由微信生成的Open ID。当您选择透过第三方支付机构或金融机构提供的支付系统或应用软件付款并向该第三方提供任何个人信息，则如前所述，本政策不适用于该第三方向您提供的产品及/或服务，我们建议您向第三方提供您的个人信息前先阅读该第三方的相关隐私或个人信息保护政策。另外，如果我们通过第三方平台向您提供产品及/或服务，则根据实际情况第三方平台的相关隐私或个人信息保护政策及本政策可能同时适用。
c) 为安排交付您购买的产品及/或服务及让我们进行客户回访，我们会把您下单时提供的收货人姓名、收货地址、收货人联系电话及订单信息向我们的物流合作伙伴提供以完成交付。您知晓并同意我们的物流合作伙伴获知及使用该些信息以完成交付目的。
3.3 为您提供奖赏计划、优惠、礼遇兑换及其他商场配套服务
a) 当您参与我们及/或我们与合作伙伴包括第三方商户合作提供的奖赏计划，及/或申请兑换我们及/或我们与合作伙伴包括第三方商户合作提供的优惠及礼遇，包括但不限于停车场优惠、抽奖礼品兑换及免费WI-FI登陆等，您需要先注册成为我们的会员，我们会根据您注册时提供的个人信息处理及核实您就本条提出的申请。我们也可能需要将您的个人信息提供给合作伙伴包括第三方商户。此外，我们亦可能根据相关法律法规把您的个人信息提供给相关部门进行报税。
b) 我们致力提升物业管理服务效率及管理公共卫生风险。如果您现为K11 Atelier租户的员工或授权人，您可以申请登记开通K11 Atelier人脸闸机系统。登记开通前，您需要先关注K11 Atelier的微信公众号和注册成为K11会员。
登记的过程中，您需要通过我们的应用软件上传您的脸部特征样本，并提供及绑定您的姓名、实体K11物业通行卡号、K11会员号、K11 Atelier租户办公楼层和K11 Atelier租户的名称。收到您的信息后，我们会展开审核及与相关K11 Atelier租户核实信息。审核通过后，我们会开通上述系统权限。如果需要您提供其他资料或无法为您开通上述系统权限，我们将在[5]个工作天内告知。
K11 Atelier的人脸闸机系统权限一经开通，您进出K11 Atelier 物业时仅需要根据指示在闸机前进行刷脸以验证身份。完成验证后，我们的系统将为您自动分派电梯并自动选定您的办公楼层。识别过程中您无需使用实体卡，亦无需接触电梯的按钮。另外，我们也会通过K11 Atelier微信公众号向您非精准推送K11商场活动信息和其他通知。开通K11 Atelier人脸闸机系统与否不影响您以实体K11物业通行卡进出物业。如果您不提供第3.3(b)条的个人信息，这不会影响您使用我们的产品及/或服务的其他功能。
如果您对K11 Atelier人脸闸机系统有任何疑问、希望申请停止使用或行使您作为个人信息主体的合法权利，欢迎通过第12条所列方式向我们联系或与我们的物业前台客服联络。
c) 我们致力提升物业管理服务效率及管理公共卫生风险。如果您申请登记开通K11人脸停车场智能寻车系统，您需要先并注册成为K11会员。
登记的过程中，您需要通过相关平台上传您的脸部特征样本，和提供及绑定您的姓名、K11会员号、车辆信息及车牌号。收到您的信息后，我们会展开审核并在审核通过后开通上述系统权限。如果需要您提供其他资料或无法为您开通上述系统权限，我们将在[5]个工作天内告知。
K11人脸停车场智能寻车系统权限一经开通，您进出K11停车场时仅需要根据指示在闸机前进行刷脸以验证身份。完成验证后，我们的系统将记录您停放车辆的位置。我们及后将结合您的脸部特征、车辆位置信息、车辆信息及车牌号为你提供导航智能寻车服务。开通K11人脸停车场智能寻车系统与否不影响您以非人脸停车导航方式使用我们的寻车服务。如果您不提供第3.3(c)条的个人信息，这不会影响您使用我们的产品及/或服务的其他功能。
如果您对K11人脸停车场智能寻车系统有任何疑问、希望申请停止使用或行使您作为个人信息主体的合法权利，欢迎通过第12条所列方式向我们联系或与我们的物业前台客服联络。
d) 如果您使用我们提供的“K11无感积分服务”（该服务意思指，您在K11 商户消费并通过与我们合作的银行、腾讯、支付宝或其他支付机构平台支付后，所述合作机构将向我们提供您的支付账号信息、交易信息、微信ID、系统账号及识别码包括由微信生成的Open ID，我们即可自动为您核对并登记K11积分，过程中您无需再向K11提交其他信息），除先要注册成为我们的会员，您亦需要先向银行、腾讯、支付宝或其他支付机构平台同意向我们提供能为您完成当次交易的无感积分所必要的支付账号信息、交易信息、微信ID、系统账号及识别码包括由微信生成的Open ID，并同意由银行、腾讯、支付宝或其他支付机构平台通过其授权或引入的第三方服务商向我们提供该些个人信息。过程中，我们也会向合作机构提供您的个人信息以核实您的身份。如果您不同意上述关于您个人信息的安排，您将无法使用“K11无感积分服务“，但这不会影响您使用我们的产品及/或服务的其他功能。
3.4 为您提供评论、分享、关注、问卷调查、上载等信息公开发布功能
a) 当您通过我们的询问、问卷调查或其他平台或方式对我们的产品及/或服务进行评论、评价、分享、关注、问卷调查或上载（包括照片、视频、语音、文字）等信息公开发布的活动时，您需要先注册成为会员，我们也会收集您的网络协议位置（IP address）及手机型号，我们也会在您公开发布的信息当中收集您主动公开的个人信息，作数据统计、后台报表及兑换奖赏之用。在符合法律法规的情况下，我们可能会进行数据整合、分析及研究，从而跟您互动并作个性化展示及推荐我们及/或新世界集团关联方的产品及服务的资讯。
3.5 展示我们的产品及/或服务的信息
a) 您可以以会员或非会员的身份浏览我们的产品及/或服务的信息，过程中我们会收集您的设备信息（即H5应用检测、Wifipix）、浏览器信息（即浏览器类型、微信版本、浏览器代理头、系统语言、flash版本、分辨率、色彩、MAC ID、浏览时间、网络协议位置（IP address）、域名）、日志信息及地理位置信息，以为您展示产品及/或服务信息。
b) 经您同意，我们会收集您的搜寻、点击、分享、关注及浏览记录、收藏及添加至购物车记录、使用语言、访问日期和时间，并根据您的设备信息、浏览器信息、日志信息及地理位置信息及您根据本政策第3.1(a)条的个人信息（如适用），在符合法律法规的情况下为您提供更便捷、更符合您个性化需求的信息展示、搜索及推送服务。与此同时，我们会提供不针对您个人特征的选项。
c) 请注意，单独的设备及浏览器信息、服务日志信息、搜寻、点击、分享、关注及浏览记录、收藏及添加至购物车记录、使用语言、访问日期和时间是无法识别特定自然人身份的信息，故我们有权以任何目的进行使用。如果我们将其与您的个人信息结合使用，我们将根据本政策对其进行处理及保护。
a) 为让您更了解我们和新世界集团关联方所提供的多元化业务、产品及服务，并提升您的整体消费及购物体验，我们会对根据第3条基于不同业务功能所收集的个人信息进行数据整合、分析、研究并形成用户画像，据此我们可能向您展示及推荐您可能对我们及/或新世界集团关联方提供的产品及服务感兴趣的资讯。
b) 如果您不希望接收我们向您展示及推荐的产品及/或服务的资讯，您可通过第12条的联系方式与我们联系。
在一般情况下，我们不会与我们以外的任何公司、组织和个人分享您的个人信息，但您理解并同意在以下情况例外：
a) 为实现本政策第3条所列的产品及/或服务功能，我们可与新世界集团关联方或其他提供技术支援、支付、物流、广告或分析服务的合作伙伴、合作商、代理、承包商、供应商、服务提供商可共享您的个人信息（包括您的个人敏感信息）。如果您不同意，您可通过第12条所列方式联系我们撤回同意；及
b) 我们根据适用的法律法规规定或响应强制性的行政或司法要求提供您的个人信息。
对我们共享个人信息的公司、组织和个人，我们会与其签署合同及保密协议，要求他们按照我们的要求、本政策以及其他相关的保密和安全措施来处理您的个人信息。我们的合作伙伴无权将共享的个人信息用于任何其他用途，如要改变个人信息的处理目的，将再次征求你的授权同意。我们仅会出于合法、正当、必要、特定、明确的目的共享您的个人信息，并且只会共享提供服务所必要的个人信息。
5.3 转让
我们不会将您的个人信息转让给任何公司、组织和个人，但以下情况除外：
a) 在获取明确同意的情况下转让：获得您的明确同意后，我们会向其他方转让您的个人信息；
b) 在我们涉及合并、收购或破产清算时，如涉及到个人信息转让，我们会在要求新的持有您个人信息的公司、组织继续受本政策的约束，否则我们将要求该公司、组织重新向您征求授权同意；或

The Website is operated by K11 Concepts (Shanghai) Limited under Shanghai K11 Brand (“Shanghai K11”), and Shanghai K11 may require the user from time to time to provide his/her personal information on the Website on his/her own volition. Where the user has not yet attained 18 years old or his/her capacity for action is restricted by law, the user is required to obtain the consent of his/her parent or guardian before providing his/her personal information on the Website.
Consent to Information Collection and Use
Before providing personal information, the user shall carefully read this Privacy Policy Statement. By using or continually using the Website, the user consents to the collection, holding, retention, use or transfer of his/her personal information by Shanghai K11 in accordance with the provisions of this Privacy Policy Statement.to the extent permitted by laws of the People’s Republic of China.
Use of Log Files and Cookies
When the user visits the Website, the website server will be likely to collect the information about the user's visit (including, without limitation, the user's IP address, domain name, browser type and length of visit) via Cookies and other automatic collection ways (collectively as "Cookies"), but will not track his/her personal information. Type of Information Collected and Held
The personal information provided by the user as may be required by Shanghai K11 for various purposes during the process of business operation shall include, without limitation, the user's name, gender, email address, username, password, device identification, location, mailing address, contact telephone, membership number, age range or age, date of birth, marital status, family status, level of education, occupation, identity document number, household income range, consumption type, credit card information, etc.
Intended Use of Information Collected
Shanghai K11 may use the user's personal information for the following purposes: its daily operation activities, membership account number and file management, R&D, advertising, marketing, public relations and marketing (including joint-sale), delivering news and information, identification, order treatment, providing commodities, services, benefits, discounts and promotion activities to meet specific demands, fundraising, information and database management or using the user's personal information for other purposes relating to the aforesaid matters.
At the same time, to the extent permitted by laws of the People’s Republic of China, Shanghai K11 may apply the information collection via some service to other services provided through the Website by information collection or otherwise. For example, the information provided by the user in using some a certain service of the Website may be applied to another service to provide specific content to the user, or exhibit the information relevant to the user to meet specific demands. The user hereby agrees that, to the extent of the aforesaid purpose, the user hereby authorizes Shanghai K11 to apply the information used and stored in a certain service to other services provided through the Website.
Confidentiality Obligation of Information
The Website will not provide, sell, lease, share and trade the user's personal information to any irrelevant third party; provided, however, for the convenience of users to use the services (collectively as “other services”) of Shanghai K11 and members of New World Group (as defined in Article10 below), the user agrees and authorizes Shanghai K11 to communicate his/her personal information to such members accepting other services, or obtain the same from such members providing other services to the user.
The Website shall conduct comprehensive statistics on the identity and transaction data of the user and/or the user's company, and will only disclose such comprehensive statistics to advertisers, merchants or news agencies only for the purpose set forth in Article 5. However, in such cases, the Website will not disclose to the aforesaid institutions any information that may be used to identify the user's personal identity or financial status, except for that obtained by analyzing the user's username or other disclosable data.
The user agrees that the Website may disclose or use the user's personal information to identify and/or confirm his/her identity, or resolving disputes, or help to ensure the security of the website, restrict fraudulent, illegal or other criminal activities in order to implement the service agreement of the Website.
The user agrees that the Website may disclose or use his/her personal information to secure his/her life and property, or to prevent the user from seriously infringing upon legal rights and interests of others, or for the purpose of public interest.
The user agrees that the Website may disclose or use his/her personal information to improve the website services and cause such services to better meet the user's needs, so as to provide the user with better experience in using such services.
When the Website provides the user's information as required by law, or government or the right holder for the purpose of identifying the alleged infringer, the Website will disclose the user's information in good faith.
Push Notification and Delivery
When the user is using the services provided by the Website, Shanghai K11 may use the user's personal information and browsing history to deliver news and notifications, send emails or push notifications to his/her computer, mobile phone or other devices. If the user does not wish to receive such notifications, he may select "Unsubscribe" on his/her computer, mobile phone or other devices based on relevant instructions in the Website.
Shanghai K11 or the Website may make service-related announcements to the user if necessary (if some service is suspended due to system maintenance). Such announcements are not for the purpose of promotion in nature and thus probably cannot be cancelled.
Information Accuracy
Shanghai K11 may require the user to provide some personal information (in particular his/her contact information) with respect to specific services. If the user fails to provide or update accurate information as required by the Website, Shanghai K11’s provision of such specific services may be affected. If the user wishes to correct or update his/her personal information held by Shanghai K11, please contact Shanghai K11 [(8621) 23103188/63876688].
Information Retention
Shanghai K11 shall have the right to retain the user's personal information for a certain period, and the termination of such period shall be conditional on the realization of the intended purpose of such information.

For the purpose set forth in Article 5 above, Shanghai K11 may share the user's personal information with the following entities located in Hong Kong or Mainland China or transfer the same to such entities: K11 Concepts Limited, K11 Group Limited, New World Development Company Limited, Chow Tai Fook Jewelry Group Limited, and their respective holding companies, affiliated companies, subsidiaries, and any companies in which interests are held thereby (collectively as "New World Group"), Shanghai K11's business partners, partners, agents, contractors, suppliers, Service Providers, new owners of Shanghai K11's businesses, enforcement authorities, competent authorities, government departments and relevant organizations, courts and arbitral authorities.
If Shanghai K11 participates in merger, acquisition, asset sale or reorganization as required by law or due to other reasons, Shanghai K11 may disclose personal information to the parties thereto.
In the reorganization process, Shanghai K11 may disclose personal information to the parties to the aforesaid transactions.In addition, if the user has participated in any online forum on the Website, then the user may share with other participants in such forum any of his/her personal information published on the Website. As long as the user does not delete such shared information, relevant information will be saved in public domain; even if the user deletes such shared information, relevant information is still likely to be independently cached, duplicated or stored by other users or other irrelevant third parties beyond the control of Shanghai K11 or the Website. In such case, the party who has obtained the user's personal information may be located in China or any other jurisdiction outside of China. Service Providers
Shanghai K11 may provide the user's personal information to other individuals or companies providing services to it ("Service Providers"). In such case, the Service Providers shall use the user's personal information in accordance with the agreement signed by Shanghai K11 and the requirements of this Privacy Policy Statement, and bear confidentiality obligations based on Articles 6 and 10 hereof.
Information Sharing
For the purpose set forth in Article 5, Shanghai K11 may share the user's personal information with other databases of New World Group, provided that Shanghai K11 ensures such sharing will comply with Article 10 hereof.
Exceptions
